Question: Can I smoke with my medical card?
Short answer: usually no—you can’t use ma*****na and hold a CDL, even with a medical card.
Here’s why:
Federal law overrides state law
CDL drivers are regulated by the Federal Motor Carrier Safety Administration (FMCSA), and they follow federal rules—not state laws.
Ma*****na is still illegal under federal law.
The U.S. Department of Transportation (DOT) requires drug testing for CDL drivers.
Any THC in your system = a positive drug test, even if you have a valid medical ma*****na card.
What happens if you test positive?
You cannot perform safety-sensitive duties (driving a commercial vehicle)
You’ll be removed from duty immediately
You must complete the Return-to-Duty process (with a Substance Abuse Professional)
It can impact your job and future employment
Important clarification
Having a medical ma*****na card does NOT protect you under DOT regulations
Employers must follow federal rules, not state medical ma*****na laws.
Bottom line
You can have a CDL, but you cannot legally use ma*****na (medical or recreational) and operate under CDL/DOT regulations.

As a Federal Collector, adding DOT and non-DOT physicals as a service is essential to my business. I proudly partner with experienced and knowledgeable Nurse Practitioners who not only perform physical exams but also provide valuable education to help individuals better understand and manage their overall health.
To perform Department of Transportation (DOT) physicals, medical examiners must be licensed healthcare professionals—such as MDs, DOs, PAs, NPs, or DCs—and must be registered with the FMCSA National Registry of Certified Medical Examiners. These examiners are required to follow strict federal guidelines, which include conducting a thorough health history review and performing key components of the physical exam such as vision, hearing, and urinalysis. All results must be reported electronically to the registry.
To become certified, medical examiners must complete required training and pass a certification exam to be listed on the National Registry. Only approved provider types—licensed physicians (MD/DO/DC), physician assistants (PA), and advanced practice nurses (NP)—are eligible to perform DOT physicals.
