We will admit — we are a little disappointed in the latest response we received during the zoning clarification process.

Not because we expected anyone to build an entire legal library online for us, and NOT because we expect government employees to instantly answer every question the second we ask them.

What disappointed us was something much simpler.

After spending several days researching the ordinances, locating the application, tracing hearing procedures through multiple sections of the municipal code, reviewing hearing timelines, locating zoning maps, and compiling very specific procedural questions, we still have not received clarification on many of the actual process questions themselves.

Questions like:

Where exactly is the application formally submitted?
Where are fees paid?
Which notice timeline controls?
How is the 300-foot rule applied?
What happens after Zoning Board approval?
Are there additional City Clerk procedures?
Is there a formal procedural checklist?

Those are not “website design” questions. Those are actual workflow questions that would still exist even with a perfect website.

To be clear, we are not angry, and we are not trying to be adversarial with the City or its employees. In fact, we appreciate the responses we have received and understand everyone is busy.

But we also believe small business owners should be able to reasonably understand the process they are expected to follow before unknowingly missing a deadline, filing step, hearing requirement, or procedural rule.

At this point, we are simply trying to obtain clear procedural direction so we can:

properly submit our application,
avoid unnecessary delays,
and continue building a public guide that may help future entrepreneurs navigate the same process with fewer headaches.

We also wanted to call ourselves out. We felt the original response was slightly longer than we thought appropriate for online posting so we did not post our response back to the city. In which we sent a follow up response to our response fixing our questions so we could get the right answers without needing to correct the process that we also did not post.

We did however promise transparency throughout the process so we ended up having to do multiple screenshots to attach the emails. Our sincerest apologies for not having complete transparency as it happened. We will strive to post everything so that there is no question as to how to potentially navigate concerns around required information. Those emails are attached. In order and should be labeled.

Hopefully we can continue narrowing things down and get the remaining clarification needed soon.

We received a response from the City regarding the Special Use process connected to our beer and wine license application.

After reviewing the City's response, researching the municipal code, locating the application, and reviewing the publicly available zoning materials, we decided to begin organizing everything into a simple step-by-step guide for future entrepreneurs and business owners attempting to navigate similar processes.'

Below is what we have SO FAR. This guide will change.

Before you spend money, fill out forms, or plan alcohol sales, you first need to determine whether your business activity requires a Special Use Permit and hearing.

Without locating this section, an applicant may not even realize a hearing process exists. Read this section carefully and understand the procedures before moving forward.

Step 6: Determine which zoning district applies to your property.

Step 7: Compare your zoning district against Section 1345.01 to determine whether alcohol sales appear eligible for Special Use consideration within that district.

The zoning map does appear to be located on the Maps & Zoning page. However, depending on the location and map clarity, applicants may still need assistance confirming their exact zoning district.

Because of this, applicants may wish to request written zoning confirmation from the City before investing significant time or money into the Special Use process.

Several procedural requirements referenced in the City's response did not appear to be located within the Maps & Zoning section or directly within the application materials where we were initially directed.

Instead, portions of the process only appeared after separately reviewing the Municipal Code and hearing procedures.

We also located references to different notice periods within the ordinance sections and requested clarification from the City regarding which notice timeline controls the process.

Finding the ordinance and locating the form are only part of the process. Applicants still need to determine where the completed application must actually be submitted, whether submission may occur online, and which City office formally receives and processes Special Use applications.

# # # What We Found

The "Application for Zoning Permit" form lists the following address at the top of the document:

**100 Courthouse Rd.
Princeton, WV 24740**

However, during our review, we were unable to locate any instruction within the application specifically stating:

• where completed applications must be submitted
• whether submission is required in person
• whether applications may be submitted electronically
• which City office formally receives the application
• or whether Special Use applications follow a different submission process

Additionally, while the application references the Courthouse Road address, the City's current Maps & Zoning and Code Enforcement information appears to reference operations through the Municipal Complex located at:

**800 Bee Street
Princeton, WV 24740**

At this time, we have not located publicly available materials clearly explaining whether zoning and Special Use applications are submitted at the Courthouse Road address, the Bee Street Municipal Complex, or through another department entirely.

Because of this, we requested clarification from the City so future applicants can better understand the proper submission process and avoid inadvertently submitting paperwork to the incorrect location or department.

Additional Questions Raised During The Process.

Our response was a very lenghty one but only to clarify some of the things we just couldn't find answers to. Here is the summary.

1. Where is the $75 hearing fee schedule publicly listed?
2. Who should the hearing fee be made payable to?
3. Where should payment be submitted?
4. Which public notice period controls the process?
5. What happens after approval by the Zoning Board of Appeals?
6. Does the City Clerk have additional steps or sign-offs connected to the State alcohol licensing process?
7. Where is the completed application required to be submitted, as the application itself does not appear to identify a submission department or clearly specify the submission location?
8. Is submission of the application required in person, or may applications be submitted electronically by email or another online method?
9. If applications must be submitted in person, should submission occur at 100 Courthouse Road, the Municipal Complex located at 800 Bee Street, or another City office or department?
10. Is there a publicly available zoning map that allows applicants to verify whether their property is located within a district eligible for Special Use consideration involving alcohol sales?
11. Does the City provide written zoning verification confirming the zoning classification applicable to a business address prior to submission of a Special Use application?
12. Is involvement by the City Attorney a standard part of the Special Use clarification process, or are there additional legal or procedural requirements not publicly outlined within the City's publicly available materials?
13. Is there a publicly available procedural checklist identifying the operational information applicants are expected to provide concerning seating, kitchen operations, menu items, hours of operation, beverage service procedures, or similar business details?
14. Are there any additional application materials, attachments, drawings, site plans, floor plans, or supporting documentation typically expected during submission of a Special Use request that are not specifically identified within the publicly available application materials?
15. Section 1345.01 appears to reference a 300-foot distance requirement associated with alcohol sales. Could you please clarify what locations or property types this distance requirement applies to, how the measurement is calculated, and whether the City provides any formal zoning or distance verification during the application process?

We also noticed the City Attorney was CC'd on the response email. We are unsure whether this was standard procedure or accidental.

Since this appears to be a basic procedural inquiry, we may also seek clarification as to whether involvement by the City Attorney is a standard part of the Special Use clarification process or whether there are additional legal or procedural requirements not publicly outlined within the City's materials. This would help ensure no procedural step is inadvertently missed during the application process or help us better understand why the City Attorney would need to be involved in what appears to be a basic zoning clarification request.

We also noted the request for additional operational details concerning seating, kitchen operations, menu items, hours of operation, and beverage service procedures. While we understand the Board may require sufficient information to evaluate a Special Use request, we were unable to locate a publicly outlined procedural checklist or application requirement specifically identifying those items during our review of the City's publicly available materials. We are not saying this information is not important. Capacity, seating, hours of operations and beverage procedures. (We are not sure whether ‘beverage procedures’ means our serving and compliance procedures or how we actually make our drinks. One would likely be public process information while the other could involve proprietary business methods)

Our goal is simple: document the process clearly so future entrepreneurs can understand what to do, where to go, and what questions to ask.

If we misunderstood anything, we welcome clarification from the city and will gladly correct the guide. We want to give as much detail as possible so our future business owners can get through the process without much hassle or unnecessary road blocks that they might run into.

And so for now we wait! You do a lot of that. Don't take it personally. Sometimes people are just busy and will get to you when they can. We will get a response and a revision to our guide as soon as we can.

Step 2: Following Up on the Zoning Request

The wine slushie quest continues... We got the new machines in and the flavors are ready to go. Sadly, we are hitting a communication roadblock.

Many times, waiting and following up for a response are simply part of starting, operating, and expanding a business. Staying professional throughout the process is important, especially when enthusiasm for moving forward exceeds the speed of communication—or when the level of communication doesn't quite match the level of interest in getting things done.

We sent our initial inquiry regarding zoning and licensing requirements and, as of today, have not yet received a response. To keep the process moving, we submitted a follow-up request seeking guidance on any zoning requirements, permits, approvals, or other municipal requirements that may apply.

As promised, we'll continue documenting every step of the process and sharing what we learn along the way. If you're considering starting a business someday, we hope this provides a helpful look at the realities of entrepreneurship—the exciting parts, the paperwork, and occasionally, the waiting game.

Dear Princeton Drivers,

We know everyone is in a hurry. Work. School. Appointments. Life.

But no pastry, coffee, meeting, or errand is worth someone's life.

Lately we've watched cars fly through town at speeds that have no business being on city streets. We see families crossing roads, kids walking, customers entering businesses, and employees coming to work every day. It only takes one mistake for a speeding driver to change lives forever.

We also can't help but notice that some of the speed-monitoring signs that once reminded drivers to slow down are no longer there. We have no idea why they were removed but we pay enough in taxes that we should have our roads and speed detecting signs there trying to save lives rather than spending our tax money making waves. While signs alone won't solve the problem, visible traffic safety efforts send a message that speeding matters.

We have also had not only 3 tragic deaths recently but also hit and runs have been reported.

As a local business, we're asking for two simple things:

Drivers: Slow down.
City leaders: Make traffic enforcement and traffic safety a priority.

Princeton is more than a road to pass through. It's our home. It's where our children live, where our customers shop, and where our neighbors work.

Please slow down. Someone's family is waiting for them to get home.
