TERMS AND CONDITIONS
By accepting this cake agreement and paying a deposit, you agree to be subject to these Terms and Conditions.
Please read the following Terms and Conditions carefully before placing your order with YUMMY YUMMY CAKES.
By using the YUMMY YUMMY CAKES service, you agree to be bound by these Terms and Conditions.
We reserve the right to refuse the sale of goods or services or to cancel an order under certain circumstances.
Please be aware that all photographs taken of your cakes prior to delivery remain property of YUMMY YUMMY CAKES.
DEPOSIT INFORMATION
A deposit (via bank transfer or cash) is required to confirm a booking. No order will commence until a deposit has been paid & received. Once the deposit has been paid, the quoted price remains fixed to the details in the quote.
BALANCE DUE
The balance of payment is due (via bank transfer or cash) TWO WEEKS prior to delivery. Orders will not be delivered or completed unless paid in full.
If placing an order within that two week period, then full payment is due & payable for this order to proceed.
YOUR FINAL BALANCE
must be received by the due date indicated or this contract is null and void, and your deposit will not be refunded.
WEDDING CAKES
A deposit of $100.00 must be paid on booking your wedding cake to hold your date and final payment must be made (4) four months before the date of your event. Please note that regular payments must be made on wedding cakes and payment must be finalised by the due date or YUMMY YUMMY CAKES has the right to cancel your order and depending on the design and the time frame of cancellation the amount of your deposit refund will depend on what supplies have been purchased or if sugar craft items have been made and how many sugar craft items have been made eg:- flowers, figurines etc.
BIRTHDAY & CELEBRATION CAKES
under $100.00 must be paid for in full on booking your date, over $100.00 a deposit is required and your final payment must be made (2) two weeks before the date of your event.
SUGAR COOKIES
Cookies are made in batches of 12 per order, they are not gluten free and are made with butter, eggs, flour, sugar, cookies can be either decorated with fondant or royal icing they will be decorated with fondant unless specified otherwise. Cookies will be individually packaged in sealed cookie bags, cookies must be kept in a cool dry place, not refrigerated. Yummy Yummy Cakes takes no responsibility for any damage after they are picked up by you the customer or once they have been delivered.
CONFIRMATION OF ORDERS
Please ensure all contact details, personal information, spelling of names, design requirements, delivery & collection details and any requested changes have been properly documented on your cake confirmation. Notify YUMMY YUMMY CAKES via Phone, page or Email immediately of any errors.
CANCELLATIONS/CHANGE OF DATE
All cancellations/changes must be received in writing or via page or Facebook messenger.
If you cancel your order prior to 14 days out from your event, a $100 cancellation fee will apply.
If an order is cancelled within 14 days prior to the event date, then the full deposit will be forfeited.
And if your order is cancelled within 7 days of your event, any balances outstanding will be due and payable.
If the date is changed, there is a $50 administration fee “every time” the date is changed.
However, if YUMMY YUMMY CAKES have to cancel the order with you for any particular reason due to health, family or situations out of our control, a full refund will be provided to you, as well as assistance in finding a suitable decorator with similar experience to complete your order.
CHANGES
We ask that all changes are made prior to the two week cut off period. The date of your final payment is the final date for any changes to sizes, style, flavours, colours and decoration to your cake. Any changes requested after this date cannot be guaranteed and may be subject to additional costs. Thank you for your understanding.
QUALITY
At YUMMY YUMMY CAKES we pride ourselves on the quality of our products and services.
All our ingredients are of the highest quality. All cakes/cupcakes/cookies are made in premises in which nuts are used, every effort is taken to keep ingredients separate however cakes/cupcakes/cookies may contain traces of nuts.
Our products are NOT gluten free and eggs, butter, sugar and flour are used in the making of our products.
It is important to remember that cakes/cupcakes/cookies are a perishable and delicate product.
Our aim is to provide only the freshest and highest quality cakes/cupcakes/cookies to our customers.
FLOWERS
If flowers are provided by an outside source, we will arrange up to 25 stems free, $1.00 for each additional stem. You acknowledge that fresh flowers are not a food product and may contain pesticides, insects, dirt or other contaminants; We at YUMMY YUMMY CAKES take NO responsibility for any fresh flowers that have been added to any cakes/cupcakes/cookies after delivery and set up or any cakes/cupcakes/cookies that have been picked up by you the customer.
STORAGE
Fondant (the soft icing covering the cake) is not designed to be refrigerated and as such cakes/cupcakes/cookies with this icing should be stored in a cool dry place, preferable in the box they were supplied in. Refrigeration may cause colours to run/bleed. Please keep all cakes/cupcakes/cookies and figurines out of direct sunlight. Failure to store the cake correctly may result in colours fading, cracks or melting.
DAMAGE
If for some reason the cake/cupcakes/cookies have been damaged when it has left our premises, or after delivery to the venue, then we take no responsibility.
However, if you request an emergency call-out, we will endeavour to restore the cake/cupcakes/cookies to their original presentation, at an agreed call-out fee. You are responsible for providing an appropriate and secure table and environment for the cake/cupcakes/cookies,
Cakes are heavy and require a sturdy table, and optimal room temperature of 16-25 degrees Celsius.
DELIVERY
Delivery of your cake/cupcakes/cookies can be organised for you. We require an address to provide a quotation. Cake deliveries are made within reasonable business hours.
VIEWING
The end of the week, when orders are being completed, is a very busy time in the kitchen. Please do not request images of cakes prior to pickup/delivery, we don’t offer this service.

PHOTOGRAPHS
YUMMY YUMMY CAKES reserves the right to take and use photographs of your cake/cupcakes/cookies and desserts, before, during and after set up, to use for marketing, advertising, and promotional purposes, without compensation to you.
VARIATIONS FROM PICTURED ITEMS
Please understand if a picture/image is supplied, then in some cases it may be necessary to change a colour or vary a product from the picture as certain items may be unavailable from time to time. We are not copy cat decorators, and can only try to replicate what we can, within our limits.
Where items are provided on cakes (plastic figures, toys or handmade sugared items) they are strictly provided as decorations on a cake, and it is advised that these are not consumed. Some figurines and decorations may contain wire or toothpicks which are dangerous if consumed. If there are any breakages or faults with the items after they are removed from the cake, then if time permits these can be replaced at an agreed cost.
REFUNDS
As each cake is unique, so too, are your special requirements and concerns surrounding your order.
If there is an issue with your order please note that you must refrigerate or freeze the cake immediately and return it to us on the next business day if we are to consider any refunds at all, this also includes cupcakes and cookies.
CAKE STAND HIRE
We offer a number of different cake stands for hire, a deposit of $50.00 is required to hold the stand for your event this deposit is refundable via bank transfer providing the stand is returned to Yummy Yummy Cakes no more than 3 days after your event and provided the stand is returned in the condition it was hired out to you, your deposit will be forfeited if the stand returns broken, damaged etc for each day after the 3 day grace period for returns a $5.00 fee will be taken from your holding deposit until the stand is returned, a $20.00 non refundable fee is charged for the hire of the stand some stands are at a higher cost depending on what stand you require.
DISCLOSURE OF INFORMATION
YUMMY YUMMY CAKES will not disclose any personal information such as your name, address, email or telephone number to any person outside of the company, unless the customer has authorised us to do so or unless required by law to disclose such information.
Furthermore, under no circumstances will YUMMY YUMMY CAKES sell or receive payments or services for disclosing customer’s personal information to any partner or external company.
AGREEMENT TO TERMS & CONDITIONS
Performance of this agreement is contingent upon the ability of YUMMY YUMMY CAKES to complete the agreement and is subject to disputes or strikes, accidents, Acts of God, and other causes beyond our control.
By proceeding with a purchase you are in agreement with our terms and conditions as stated above.
