1 CO₂ tank can trigger HMBP reporting.

Under California law, the reporting threshold for a compressed gas is:

200 cubic feet

A standard 50-lb CO₂ cylinder contains approx. 435 cubic feet.

That means:

ONE typical restaurant soda tank exceeds the threshold.

WHAT THIS MEANS

If you have one standard CO₂ cylinder onsite, you may be required to:

✔ Submit a Hazardous Materials Business Plan (HMBP)
✔ List CO₂ in your CERS inventory
✔ Maintain a compliant site map
✔ Maintain an emergency response & training plan
✔ Certify annually in CERS

Regulated under:
• Health & Safety Code, Division 20, Chapter 6.95
• Title 19 CCR
• California Fire Code – Compressed Gases



CO₂ is not “just soda gas.”
It is a regulated compressed gas.

• Create a CERS account
• Maintain an active EPA ID (if applicable)
• Report chemical inventories & facility data
• Obtain an annual permit from their local CUPA (Fire Dept or Environmental Health)
