๐ค To everyone stopping by our stand and asking, "What's next for Salty Dog?"โhere is our official legal update๐
After our occupancy permit application for Scout Lake Park was denied and subsequently upheld by the Village of Greendale Zoning Board of Appeals, we exhausted all local administrative options. To protect our small business and seek a fair, consistent application of municipal rules, Salty Dog Farm Stand LLC formally filed a civil lawsuit in Milwaukee County Circuit Court (Case No. 2026CV007349) on August 7, 2026.
What our lawsuit specifically addresses:
1๏ธโฃ Procedural Due Process (42 U.S.C. ยง 1983): Our complaint alleges that the administrative review and permit denial process lacked fair, consistent procedural due process.
2๏ธโฃ Arbitrary & Inconsistent Enforcement: We assert that the Village applied a changed zoning standard to our Scout Lake application, despite previously issuing us a valid Certificate of Occupancy for the exact same operational model in April 2025.
3๏ธโฃ Declaratory Relief on Park Land Zoning: We are seeking a formal judicial determination regarding how local municipal zoning codes (ยง 17.28) apply to approved concession vendors operating on Milwaukee County park property.
Where we stand today: We are fully open, active, and baking at our current location! While the Village recently designated our current site as a "non-conforming use," that legal status explicitly permits us to continue operating right where we are.
We made plans to move to Scout Lake Park to proactively address customer parking and traffic safety, and we are utilizing the court system to achieve a clear, lawful path forward. Thank you all for your overwhelming encouragement and support as we navigate this process!
