ঢাকা, ২৯ আগস্ট ২০২৬: জোরপূর্বক গুমের শিকার ব্যক্তিদের স্মরণে আন্তর্জাতিক দিবস উপলক্ষে আজ অধিকার একটি আলোচনা সভার আয়োজন করে। একই সঙ্গে বাংলাদেশ জোরপূর্বক গুম থেকে সকল ব্যক্তির সুরক্ষার জন্য আন্তর্জাতিক কনভেনশনে (ICPPED) যোগদানের দুই বছর পূর্তি আজ।
ঢাকার বিশ্বসাহিত্য কেন্দ্রে আয়োজিত অনুষ্ঠানে জোরপূর্বক গুমের শিকার ব্যক্তি ও তাঁদের পরিবারের সদস্য, সংসদ সদস্য, মানবাধিকারকর্মী, কূটনীতিক, নাগরিক সমাজের প্রতিনিধি এবং সাংবাদিকরা অংশগ্রহণ করেন।
অনুষ্ঠানটি সঞ্চালনা করেন অধিকারের পরিচালক (প্রোগ্রামস) সাজ্জাদ হোসাইন। অনুষ্ঠানের সূচনা বক্তব্য দেন অধিকারের পরিচালক (অ্যাডভোকেসি) তাসকিন ফাহমিনা। তিনি জোরপূর্বক গুমের পরিস্থিতি ও সংশ্লিষ্ট বিভিন্ন বিষয়ে একটি প্রবন্ধ উপস্থাপন করেন।
বিএনপি সরকার ক্ষমতায় আসার পর জোরপূর্বক গুমের প্রথম শিকার বাগেরহাটের মিরাজ শেখ। ১০ এপ্রিল ২০২৬ তাঁকে গুম করা হয় এবং এখন পর্যন্ত তাঁর কোনো সন্ধান পাওয়া যায়নি। সভায় তাঁর স্ত্রী, মা, সন্তান ও বোন উপস্থিত ছিলেন। তাঁর স্ত্রী কোস্ট গার্ডের হাতে মিরাজ শেখের অপহরণের বিবরণ তুলে ধরে তাঁর অবস্থান সম্পর্কে তথ্য প্রকাশ এবং নিরাপদে তাঁকে ফিরিয়ে দেওয়ার জন্য প্রধানমন্ত্রীর কাছে আবেদন জানান। তিনি বলেন, মিরাজ শেখ গুম হওয়ার পর থেকে তাঁর পরিবারকে গুরুতর আর্থিক সংকট, সামাজিক চাপ ও আইনশৃঙ্খলা রক্ষাকারী বাহিনীর চাপসহ নানা প্রতিকূলতার মুখোমুখি হতে হচ্ছে।
অধিকারের ইন্টার্ন এবং জোরপূর্বক গুমের শিকার ব্যক্তির কন্যা আনিশা ইসলাম ইনশা ২০১৯ সালে মিরপুর থেকে তাঁর বাবাকে অপহরণের ঘটনা তুলে ধরেন। তিনি তাঁর পরিবারের ওপর দীর্ঘদিন ধরে চলা সামাজিক চাপ, আর্থিক সংকট এবং মানসিক ট্রমার কথা বর্ণনা করেন। তিনি বলেন, গুরুতর মানবাধিকার লঙ্ঘন হিসেবে জোরপূর্বক গুমের বিচার নিশ্চিত করার পরিবর্তে রাষ্ট্র এখনো এটিকে রাজনৈতিক হাতিয়ার হিসেবে ব্যবহার করছে।
জামায়াতে ইসলামী দলের সংসদ সদস্য ও জোরপূর্বক গুম থেকে বেঁচে ফেরা মীর আহমাদ বিন কাসেম ‘জোরপূর্বক গুম প্রতিরোধ ও প্রতিকার বিল, ২০২৬’-এর খসড়াকে একটি “আবর্জনা আইন” হিসেবে আখ্যায়িত করেন। তাঁর অভিযোগ, প্রস্তাবিত আইনটি সংবিধান-স্বীকৃত মতপ্রকাশের স্বাধীনতায় হস্তক্ষেপ করে এবং আইনি প্রতিকারের সুযোগ সীমিত করে।
ন্যাশনাল সিটিজেন পার্টির সংসদ সদস্য আবদুল্লাহ আল আমিন বলেন, জোরপূর্বক গুমের ঘটনায় আন্তঃসংস্থা তদন্ত কার্যকর হওয়ার সম্ভাবনা কম, কারণ এ ধরনের ঘটনায় একাধিক রাষ্ট্রীয় সংস্থার পারস্পরিক সহযোগিতা থাকার অভিযোগ রয়েছে।
সুপ্রিম কোর্ট বার অ্যাসোসিয়েশনের সভাপতি এবং বাংলাদেশ জাতীয়তাবাদী দলের সংসদ সদস্য এ এম মাহবুব উদ্দিন খোকনও বিলটির খসড়ার সমালোচনা করেন। বিশেষ করে প্রমাণিত নয় এমন অভিযোগের ক্ষেত্রে পাঁচ বছরের কারাদণ্ডের প্রস্তাবের বিরোধিতা করেন তিনি। একই সঙ্গে আন্তঃসংস্থা তদন্ত ব্যবস্থার কার্যকারিতা নিয়েও প্রশ্ন তোলেন।তিনি ইলিয়াস আলীর গুমের ঘটনা উল্লেখ করে বলেন, আদালতে নিরাপত্তা বাহিনীর প্রতিনিধিরা এ ঘটনায় তাঁদের সম্পৃক্ততা অস্বীকার করেছিলেন। তদন্তে দৃশ্যমান কোনো অগ্রগতি হয়নি।
সভায় জোরপূর্বক গুমের শিকার ব্যক্তি ও তাঁদের পরিবারের সদস্যরা তাঁদের দীর্ঘদিনের অভিজ্ঞতা ও চলমান সংকটের কথা তুলে ধরেন। আমেনা আক্তার বৃষ্টি জানান, ১৪ বছর আগে তাঁর স্বামী ও ভাশুর গুম হওয়ার পর তাঁদের পরিবার আর্থিকভাবে বিপর্যস্ত হয়ে পড়ে এবং সামাজিক প্রতিবন্ধকতার শিকার হয়। বর্তমান বিএনপি নেতৃত্বাধীন সরকারের কাছ থেকে প্রয়োজনীয় সহযোগিতা না পাওয়ায় তিনি হতাশা প্রকাশ করেন।
ব্রিগেডিয়ার জেনারেল হাসিনুর রহমান বলেন, ঊর্ধ্বতন কর্মকর্তাদের বিরুদ্ধে নিম্নপদস্থ কর্মকর্তাদের দিয়ে তদন্ত করানো কাঠামোগতভাবেই অযৌক্তিক।
ইউনাইটেড ফর দ্য ভিকটিমস অব এনফোর্সড ডিসঅ্যাপিয়ারেন্স (UVED)-এর সাবেক রাষ্ট্রদূত এম. মারুফ জামান বলেন, আন্তর্জাতিক মানদণ্ড অনুযায়ী জাতীয় মানবাধিকার কমিশন (NHRC) একটি স্বাধীন তদন্ত সংস্থা হওয়া প্রয়োজন। এই সংস্থার আটককেন্দ্রগুলো ও সংশ্লিষ্ট নথিতে অবাধ প্রবেশাধিকার থাকতে হবে। একই সঙ্গে কমিশনার নিয়োগ প্রক্রিয়ায় স্বচ্ছতা নিশ্চিত করতে হবে এবং জোরপূর্বক গুম থেকে বেঁচে ফেরা কোনো ব্যক্তি অথবা ভুক্তভোগীর পরিবারের একজন সদস্যের জন্য কমিশনে একটি পদ সংরক্ষণের প্রস্তাব দেন তিনি।
ভয়েস অব এনফোর্সড ডিসঅ্যাপিয়ারেন্স পারসন্স (VOED)-এর আবদুল কাইয়ুম ২০১৭ সালে র্যাব-১১-এর হাতে তাঁর অপহরণের ঘটনা তুলে ধরেন। তিনি আরও বলেন, রাষ্ট্রীয় হয়রানির আশঙ্কায় জোরপূর্বক গুমের শিকার ব্যক্তি ও তাঁদের পরিবারের সদস্যদের মধ্যে দীর্ঘস্থায়ী ভয় ও নিরাপত্তাহীনতা রয়েছে।
জাতিসংঘের মানবাধিকার বিষয়ক হাইকমিশনারের কার্যালয় (OHCHR)-এর কর্মকর্তা জাহিদ হোসেন বাংলাদেশের জাতীয় আইনগত কাঠামো এবং আন্তর্জাতিক চুক্তির অধীনে বাংলাদেশের অঙ্গীকারের মধ্যে বিদ্যমান গুরুত্বপূর্ণ অসঙ্গতিগুলো তুলে ধরেন।
তিনি বলেন, ICPPED-এ বাংলাদেশের যোগদানের পর গত দুই বছরে সংঘটিত জোরপূর্বক গুমের বিষয়ে বাংলাদেশ সরকারকে একটি প্রতিবেদন প্রস্তুত করে আগামী মাসে নির্ধারিত সময়সীমার মধ্যে জমা দিতে হবে।
অধিকার সরকারকে ‘জোরপূর্বক গুম প্রতিরোধ ও প্রতিকার আইন, ২০২৬ এর খসড়া সংশোধনের জন্য জোরালো আহ্বান জানাচ্ছে। অধিকারের মতে, খসড়াটির বর্তমান রূপ জোরপূর্বক গুমের শিকার ব্যক্তি ও তাঁদের পরিবারের মতপ্রকাশের স্বাধীনতার ওপর বিধিনিষেধ আরোপসহ ন্যায়বিচার পাওয়ার ক্ষেত্রে গুরুতর বাধা সৃষ্টি করতে পারে ।অধিকার জোরপূর্বক গুমের শিকার ব্যক্তি ও তাঁদের পরিবারের প্রতি সংহতি পুনর্ব্যক্ত করছে।

On the 29th of August, Odhikar observed the International Day of the Victims of Enforced Disappearances also noting that it has been two years since Bangladesh acceded to the International Convention for the Protection of All Persons From Enforced Disappearances. The programme took place at the Bishwo Shahitto Kendro in Dhaka, and was attended by victims, victim families, members of parliament, human rights defenders, diplomats, members of civil society and journalists.
The event was moderated by Odhikar’s Director of Programmes, Sazzad Hossain, and opened by Director of Advocacy Taskin Fahmina who presented a paper on enforced disappearances.
The first victim of enforced disappearance since the BNP government came into power, was Miraj Sheikh from Bagerhat. He was disappeared on the 10th of April 2026 and his whereabouts are, to this day, unknown. His wife, mother, child and sister were present at the meeting. His wife went into the details of his abduction at the hands of the Coast Guard, making a direct plea to the Prime Minister for information and his safe return. Additionally, she spoke on the hardships she and her family have faced since his abduction, including financial issues and societal stigma around enforced disappearance family members as well as pressure from law enforcement.
Odhikar Intern and the daughter of an enforced disappearance victim, Anisha Islam Insha, recounted her father’s 2019 abduction from Mirpur, detailing the severe societal stigma, financial hardship and psychological trauma suffered by her family. She condemned the state's ongoing treatment of enforced disappearance as a political tool rather than a grave human rights violation.
Jamaat-E-Islami MP and enforced disappearance survivor Mir Ahmad Bin Quasem labelled the draft Prevention and Remedy of Enforced Disappearance Act, 2026 as a "garbage law" that infringes on constitutionally protected free speech and eliminates legal recourse. National Citizen Party MP Abdullah Al Amin warned that interagency investigations are inherently flawed because enforced disappearances rely on interagency cooperation. A M Mahbub Uddin Khokon, President of the Supreme Court Bar Association and Bangladesh Nationalist Party MP, criticised the draft Prevention and Remedy of Enforced Disappearance Bill, 2026, specifically targeting the proposed five-year prison sentence for unproven complaints and criticized interagency investigations. He cited the disappearance of Ilias Ali where security forces representatives denied involvement in open court without any subsequent progress in the investigation.
Victims and family members provided moving testimonies of ongoing state abuse and institutional failure, including Amena Akter Bristy, who shared the financial ruin and isolation forced upon her family following the disappearances of her husband and brother-in-law 15 years ago. She expressed disappointment over the lack of assistance from the current BNP-led government.
Brigadier General Hasinur Rahman highlighted the structural absurdity of expecting low-ranking officers to investigate senior officials. Former ambassador M. Maroof Zaman of United for the Victims of Enforced Disappearance (UVED), asserted that to meet international standards, the NHRC must possess an autonomous investigative body with unrestricted access to detention sites and records, along with transparent appointments that include a reserved Commissioner seat for a survivor or family member.
Abdul Qaiyum from Voice of Enforced Disappearance Persons (VOED), stated that widespread fear is persistant against victims' and their families.
OHCHR officer Zahid Hossain further highlighted critical inconsistencies between Bangladesh’s national legal framework and its international treaty commitments. He emphasised the need for Bangladesh’s government to submit the report on enforced disappearances over the last 2 years since accession to the International Convention for the Protection of All Persons from Enforced Disappearance (ICPPED), before the deadline next month.
Odhikar strongly calls on the government to amend the draft Prevention and Remedy of Enforced Disappearance Act, 2026.According to Odhikar, the current form of the draft may create serious obstacles to justice, including restrictions on the freedom of expression of thevictims of enforced disappearance and their families. Odhikar reiterates its solidarity with the victims of enforced disappearance and their families.
